WAIVER AND RELEASE OF LIABILITY AGREEMENT

This Waiver and Release of Liability Agreement (“Agreement”) is entered into by the undersigned participant and/or the participant’s parent or legal guardian (collectively “Participant”) in favor of The Rink Society, its owners, directors, officers, managers, employees, contractors, volunteers, sponsors, affiliates, partners, successors and assigns (collectively referred to as “The Rink Society”).
1. Acknowledgment of Risks
By entering the premises or participating in any activity hosted, organized, or facilitated by The Rink Society, the Participant acknowledges that activities taking place at the facility involve known and unknown risks, including but not limited to: physical injuries, collisions, falls, illness, equipment malfunction, negligence, and unpredictable acts of nature or third parties. These risks may result in serious injury, illness, permanent disability, death, or property damage.
2. Voluntary Participation and Assumption of Risk
The Participant certifies that they are voluntarily entering The Rink Society premises and engaging in its activities with full knowledge of the risks involved. The Participant assumes full responsibility for any and all risks, whether caused by the negligence of The Rink Society or otherwise.
3. Waiver and Release of Liability
In consideration for being permitted to enter and participate at The Rink Society, the Participant, for themselves, their heirs, assigns, personal representatives, and next of kin, hereby fully and forever releases, waives, discharges, and agrees not to sue The Rink Society from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Participant or to any property belonging to the Participant, whether caused by the negligence of The Rink Society or otherwise, including but not limited to:
- Physical injury or illness
- Property damage or loss
- Acts of God (natural disasters, weather conditions, etc.)
- Equipment failure
- Third-party acts
- Legal claims
- Medical emergencies
4. Medical Authorization and Emergency Care
The Participant authorizes The Rink Society to obtain emergency medical treatment if deemed necessary. The Participant assumes full financial responsibility for any medical care or transport rendered in connection with any injury or incident.
5. Conduct and Behavior Requirements
All Participants must conduct themselves in a respectful, responsible, and safe manner. The following are required at all times:
- No aggressive, violent, or inappropriate behavior
- Respect toward staff, other participants, and the facility
- Adherence to all posted rules and verbal instructions from staff
- Proper use of equipment and facilities
- No drugs, alcohol, or illegal substances
6. Right to Refuse Service and Terminate Access
The Rink Society reserves the absolute right to refuse entry to, or remove from the premises, any individual who violates this Agreement, fails to follow rules or staff instructions, or engages in unsafe behavior, or poses a threat to others or the facility. Such removal or termination will be without refund or compensation of any kind.
7. No Refund Policy
All fees paid to The Rink Society are strictly non-refundable under all circumstances, including but not limited to removal from the premises, cancellation of events due to unforeseen circumstances, or closure due to acts of God.
8. Indemnification
The Participant agrees to indemnify, defend, and hold harmless The Rink Society from and against any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities (including attorney’s fees) brought as a result of the Participant’s involvement at the facility and to reimburse The Rink Society for any such expenses incurred.
9. Severability
If any provision of this Agreement is found to be unenforceable or invalid under applicable law, the remaining provisions shall continue in full force and effect.
10. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising out of or relating to this Agreement or the activities of The Rink Society shall be subject to the exclusive jurisdiction of the courts located in Thailand.
11. Entire Agreement
This document constitutes the entire agreement between the parties. No oral representations, statements, or inducements apart from this written agreement shall be considered binding.
12. Binding Effect
This Agreement shall be binding upon the Participant and their heirs, personal representatives, and assigns.
